These services include review and analysis of the tax consequences of proposed
transactions and possible alternatives. If a transaction has already occurred,
suggestions are made for off-setting alternatives, if available. Based upon the
decisions made, the firm prepares or assists others in preparation of the appropriate
documents. The firm also prepares tax returns for individuals, business entities,
fiduciaries and estates.
Revocable and irrevocable trusts, including living trusts, insurance trusts,
grandchild gift trusts and charitable remainder trusts, are often among the recommended
alternatives in the tax sensitive estate plan for the lifetime enjoyment of a
person's assets and the transfer of those assets to younger generations. Services
include analysis and counsel for clients on the planning techniques available.
Since 1977 the firm has been a strong advocate of legal mechanisms to avoid the
time delays, costs and public exposure of probate court proceedings. Frequently
this includes recommendation and preparation of Revocable Living Trusts. In instances
where Trusts are not appropriate, Wills are prepared for clients and they are
counseled on ways to minimize probate exposure.
The planning process includes the client's accountants, financial planners, investment
advisers, and bank trust officers to assure that all data and decisions are fully
understood by those involved in the estate planning process.
The firm also counsels clients on the legal and financial issues relevant to
aging.
The firm guides
clients through the process, provides legal representation as required, and
attempts to minimize the executor's or conservator's time involved in the
proceedings.
The firm provides counsel and guidance on legal issues that arise in the operation
of a business including the most appropriate form of doing business (sole
proprietorship, partnership, limited liability company or corporation), and
the creation, restructuring or dissolution of corporations, partnerships
and limited liability companies.
The firm prepares documentation for all forms of real estate transactions,
from the simple to the complex, with particular expertise in simultaneous,
delayed ("Starker"), and reverse real estate exchanges.
The firm’s services to non-profit organizations, including private foundations,
involve preparation of documents on formation, ongoing administration and tax
counsel.
The firm prepares qualified pension and profit sharing retirement plans for
businesses, utilizing the office's Internal Revenue Service approved Regional
Prototype Plan. The services include preparation of the documentation necessary
to administer the plans, and counseling on administration matters.
The firm usually limits it’s practice to the areas described above.
